The agreement that governs use of this website and the transportation services we arrange. Last updated August 13, 2026.

1. Agreement

These terms govern your use of this website and any transportation services arranged by Kings Mountain Logistics (“we”, “us”). By using the site or tendering freight to us, you agree to them. If you do not agree, do not use the site or our services.

2. Our role

Depending on the service, we may act as a licensed property broker arranging transportation with authorised motor carriers, or as a carrier where we hold the relevant operating authority. Where we act as a broker, the motor carrier is the party that performs the transportation and is responsible for the care, custody and control of the freight.

3. Quotes and rates

  • Quotes are based on the information you provide and are valid for the period stated on the quote.
  • Rates may be adjusted if actual weight, dimensions, freight class, commodity or service requirements differ from what was quoted.
  • Accessorial charges — including detention, layover, liftgate, residential delivery, reconsignment, storage and driver assist — are billed as incurred and explained before invoicing.

4. Payment

Invoices are due within the terms stated on the invoice, or on receipt where no terms are stated. Late balances may accrue interest at 1.5% per month or the maximum permitted by law, whichever is lower. You are responsible for reasonable collection costs, including attorney fees, on overdue amounts.

5. Your responsibilities as shipper

  • Describe the freight accurately, including commodity, weight, dimensions, class and value.
  • Package, block and brace the freight so it withstands normal transportation.
  • Disclose hazardous materials in advance and provide required documentation. Undeclared hazmat may be refused, and you are responsible for any resulting cost or penalty.
  • Ensure someone is available to load and unload within the scheduled window.
  • Confirm that the shipment is legal to transport and not prohibited or restricted.

6. Prohibited and restricted freight

We do not arrange transportation of illegal goods, live animals, human remains, currency, firearms or ammunition without prior written agreement, or any commodity we decline in our discretion. Undeclared prohibited freight may be held or disposed of at your expense.

7. Liability

Cargo liability is governed by the Carmack Amendment, 49 U.S.C. § 14706, and by the performing carrier’s tariff and any released value declared on the bill of lading. We are not liable for delay, loss of profit, loss of use, or other consequential, incidental, special or punitive damages. Our aggregate liability for any claim arising out of a shipment will not exceed the freight charges paid for that shipment, except where a higher amount is required by law.

We are not responsible for delays or failures caused by events beyond reasonable control, including weather, road closure, accident, labour action, mechanical failure, government action, or acts of God.

8. Claims

Cargo claims are handled as set out in our Return & refund policy, including the 9-month filing window. Freight charges remain payable while a claim is pending.

9. Insurance

Carriers we use are required to carry cargo and liability insurance. Standard cargo coverage may be lower than the value of your goods. If your shipment carries a high value, tell us in advance so additional coverage can be arranged.

10. Website use

The content on this site is provided for information only and does not constitute a binding offer. Text, graphics and design on this site belong to Kings Mountain Logistics and may not be copied or reused without permission. You agree not to use the site to transmit unlawful content, attempt unauthorised access, or interfere with its operation.

11. Confidentiality

Each party will keep the other’s non-public commercial information, including rates, confidential except where disclosure is required by law or necessary to perform the service.

12. Indemnity

You agree to indemnify us against claims, losses and expenses arising from inaccurate shipment information, improper packaging, undeclared hazardous materials, or your breach of these terms.

13. Governing law

These terms are governed by the laws of the State of [Add your state], without regard to conflict of law rules, and by applicable federal transportation law. Disputes will be brought in the state or federal courts located in [Add your county and state].

14. Changes

We may revise these terms at any time. The version in effect when your shipment is tendered applies to that shipment.
